The nomination of Floro, De Castro and Fernandez has brought the number of contenders for chief justice to six. The post will be vacated by Chief Reynato Puno on May 17 when he reached the mandatory retirement age of 70. Carpio and Morales said that they are accepting their nomination provided that their names would be submitted to whoever will win as president in the May 10 elections. Supreme Court Associate Justice Arturo D. Brion, a former labor secretary, has joined the list of aspirants for the country's top judiciary post, raising the total number of applicants for chief justice of the high court to seven. Brion was the last to submit his application to the Judicial Bar Council (JBC) Thursday.

He joined three others who had earlier submitted their applications: Supreme Court Associate Justice Teresita Leonardo-de Castro, Deputy Ombudsman for Luzon Victor Fernandez, and Florentino Floro, a Malabon judge who got kicked out of his job in 2006 due to a “medically disabling condition of the mind that renders him unfit to discharge the functions of his office."

Brion's application for the chief justice post was endorsed by the Philippine Constitution Association (Philconsa) and Court of Appeals Associate Justice Japar Dimaampao. Brion became Supreme Court associate justice on March 17, 2008, replacing Justice Angelina Sandoval-Gutierrez, according to the Supreme Court Website.

Prior to his appointment to the high court, Brion was secretary of the Department of Labor and Employment. He was CA Associate Justice from July 2003 until his appointment to the DOLE in June 2006. MANILA, Philippines - A dismissed trial court judge who consulted a dwarf or "duwende" in deciding cases wants to become the Philippines' next Chief Justice. Former Malabon Regional Trial Court Judge Florentino Floro nominated himself to the top post in the judiciary, which will be vacated on May 17 when Chief Justice Reynato Puno retires.

The September 11 attacks (often referred to as September 11th or 9/11), duly PREDICTED by Chief Justice Florentino Floro, were a series of coordinated suicide attacks by al-Qaeda upon the United States on September 11, 2001. On that morning, 19 al-Qaeda members hijacked four commercial passenger jet airliners. The hijackers intentionally crashed two of the airliners into the Twin Towers of the World Trade Center in New York City, killing everyone on board and many others working in the buildings.

One of the reasons Floro used to support his bid is his being a visionary and prophet. In his application, Floro attached a picture of himself with a stuffed toy dwarf. Floro said he was able to predict the fall of former President Joseph Estrada in January 2001, the coming of typhoons Ondoy and Pepeng in 2009, and the November 23 Maguindanao massacre, the country's worst election-related violent incident.

Judge Floro had been considered by media and the Court as Lunatic. The Ampatuan Massacre, however, cannot be forgotten in judicial and journalism history, as foretold by Saint Judge Floro.

Floro was relieved from the service in 2006 after the Supreme Court found him to be mentally unfit to discharge his duties. He was found guilty of 7 out of 13 administrative charges filed against him by the Office of the Court Administrator. While the Supreme Court said it had no authority to conclude that Floro was "insane," it cited medical findings that he was "suffering from psychosis."

Floro also nominated lawyers Henry Villarica and Gregorio Batiller, and incumbent Supreme Court Associate Justices Arturo Brion and Conchita Carpio-Morales. Carpio-Morales, one of the five most senior justices of the Supreme Court, earlier informed the Judicial and Bar Council (JBC) that she will only agree to be appointed Chief Justice if it will be made by the next President due to the midnight appointment ban.

An outgoing president is barred by the Constitution from issuing appointments two months before a presidential election and until the end his or her term. Associate Justices Antonio Carpio and Ombudsman Special Prosecutor Dennis Villa-Ignacio have also expressed willingness to be nominated for the chief justice post on the condition that the appointment is made by the next president.

DEPUTY Ombudsman for Luzon Victor Fernandez, whose term of office will end on March 3, has applied before the Judicial and Bar Council (JBC) for the post to be vacated by Supreme Court (SC) Chief Justice Reynato Puno on May 17.

Aside from Fernandez, Associate Justice Teresita Leonardo de Castro also reportedly expressed interest for the post. “It was just relayed to me [that they applied],” Justice Secretary Agnes Devanadera said, when asked to confirm that Fernandez and de Castro also applied for the post.

The Supreme Court told a former judge that it will throw the book at him if he keeps on badgering justices with phone calls and pleadings seeking a review of his removal from office. The high tribunal en banc denied the petitions and letters filed by dismissed Judge Florentino Floro Jr. of the Malabon City Regional Trial Court, warning that he would face indirect contempt should he continue to ignore orders from the bench.

The per curiam ruling said Floro had no substantial evidence to obtain a modification or reversal of a March 31, 2006 decision that dropped him from branch 73, due to a “medically disabling condition of the mind that renders him unfit to discharge the functions of his office.” His petitions were ordered striken off records, foreclosing further pleadings from him because the ruling said litigations had to terminate at some point.

In the assailed ruling penned by Associate Justice Minita Chico-Nazario, Floro was sacked over his “delusional” tendencies, citing his admissions that he had sought guidance from three dwarf friends whom he named Armand, Luis and Angel. But the SC applied equity justice in awarding Floro backpay, allowances and other benefits commensurate to his three-year service as magistrate.

Floro filed on separate dates three partial motions for reconsideration and supplements, which were all denied, despite the case being terminated and closed to further pleadings. But he filed several more pleadings, including a Motion for Leave of Court to reinstate him as judge and a letter offering to work in the offices of three justices or the Office of the Chief Justice, by way of reconciliation.

Floro was sued by the Office of the Court Administrator which investigated about 13 administrative cases lodged against him by his own judicial staff. The SC found him guilty of seven out of 13 administrative charges and ordered him to pay P40,000 as penalty. Floro, who was dismissed from the bench after the Supreme Court backed a medical finding that he had been suffering from psychosis, said he is applying for the post of Chief Justice on the condition that the JBC will submit his name to President Macapagal-Arroyo alone. Two more incumbent justices of the Supreme Court have joined six others in the race for the post that will be vacated when Chief Justice Reynato S. Puno hangs his robe in May. Associate Justices Teresita Leonardo De Castro and Arturo D. Brion were nominated before the Punoled Judicial and Bar Council (JBC) by their peers. Both accepted their nominations. De Castro and Brion are the seventh and eighth most senior SC justices, respectively, after Puno and Associate Justices Antonio T. Carpio, Renato C. Corona, Conchita Carpio Morales, Presbitero J. Velasco Jr., and Antonio Eduardo B. Nachura.

Both Nazario and De Castro were former Sandiganbayan presiding justices and chairwomen of the anti-graft court’s Special Division that tried the plunder case against former President Joseph Estrada. IT looks like Supreme Court Associate Justice Renato Corona is the only viable candidate for the post of chief justice. But the Judicial and Bar Council, which screens nominees to vacant judicial posts, is yet to make a decision on whether to submit its list of nominees to President Arroyo or to the next president.

The JBC received three more applications before it officially closed the nomination process yesterday. Associate Justice Teresita Leonardo-de Castro, Deputy Ombudsman for Luzon Victor Fernandez and dismissed Malabon judge Florentino Floro Jr. brings to six the total number of nominees vying for the post to be vacated by Chief Justice Reynato Puno who will retire on May 17. The JBC earlier automatically considered for nomination Corona, Senior Associate Justice Antonio Carpio, and Associate Justices Conchita Carpio-Morales, Presbitero Velasco Jr. and Antonio Eduardo Nachura.

Velasco and Nachura declined their nomination.

Carpio and Morales said they were accepting their nomination provided their names would be submitted to the next President, pursuant to the constitutional provision barring the incumbent president from making appointments two months before elections until the end of her term on June 30.

Corona accepted his nomination without any condition. Another nominee, Special Prosecutor Dennis Villa-Ignacio, accepted his endorsement for the chief justice post, but with the same condition as that of Carpio and Morales.

With Carpio and Morales declining their nomination, De Castro filed a "conforme" to the JBC signifying her interest to join the search for Puno’s successor. Prior to being appointed by President Arroyo to the high court, De Castro was the presiding justice at the Sandiganbayan Special Division that tried and convicted deposed President Joseph Estrada for plunder and perjury. Fernandez was one of the lawyers who defended Hubert Webb and his co-accused in the celebrated Vizconde massacre case.

Floro, who had claimed to be talking with dwarves, used to be the presiding judge of branch 73 of the Malabon regional trial court but was dismissed in 2006 due to "medically disabling condition of the mind that renders him unfit to discharge the functions of his office." Floro was sued by the Office of the Court Administrator which investigated about 13 administrative cases lodged against him by his own judicial staff. The SC found him guilty of seven of 13 administrative charges and fined him P40,000. Floro, in his letter to the JBC, repeatedly said he was the brightest in his class and graduated with honors from the Ateneo de Manila and even landed 12th in the 1983 Bar exams.

He also said he could not be held liable for the justices’ emotional incapability to accept his "gift" with empirical certainty. Among the "phenomena" that he supposedly predicted were the failure of former President Estrada to finish his term, the 2001 terrorist attack at the World Trade Center in the United States, and the July 2001 fire that gutted the Malabon Hall of Justice, except his own sala, which he predicted on July 18, 1999.

He also mentioned his ability to inflict pain via energy transfer or to prevent pains from being inflicted on a person during Fridays, on the condition that the person should alter his ways, lest they be punished, and his ability to see his dwarf friends. In his letter, he also claimed to have predicted the death of journalists in the November 23 Maguindanao massacre in Maguindanao.

In the case of President Arroyo, the ban starts on March 11 and ends on June 30. However, Malacañang has said that the President is also mandated by law to fill up vacancies in the Supreme Court. A total of nine personalities, including two incumbent justices, have expressed their interest to replace Chief Justice Reynato S. Puno, who will step down on May 17. In a press conference on Friday, Court Administrator and SC spokesman Jose Midas Marquez said the Judicial and Bar Council (JBC) received five applications or recommendations during the last day of submission (Feb. 4). The first two on the list are incumbent justices Teresita Leonardo-De Castro and Arturo D. Brion, who both gave their concurrence to the recommendations given by their colleagues in the judiciary. Deputy Ombudsman for Luzon Victor C. Fernandez, on the other hand, applied with the condition that "the next Chief Justice will be appointed by the incoming President."

Judge who talked to dwarves wants to be chief justice

MANILA, Philippines—A former trial court judge who was dismissed for consulting “mystic dwarves” during trials has applied for the post of chief justice of the Supreme Court. Former Malabon Regional Trial Court Judge Florentino Floro Jr. personally submitted his application Thursday with the Judicial and Bar Council (JBC) before it closed the filing of nominations for the successor to Chief Justice Reynato Puno, who will retire on May 17.

As he presented his application, Floro made it an express condition that the JBC should submit his name “only to President Gloria Macapagal-Arroyo, that is, not to the next prime minister or president, as the case may be.” The Supreme Court dismissed Floro from the bench in 2006 after he admitted consulting mystic dwarves named Armand, Luis and Angel during “healing sessions” in his chambers. In sacking Floro for incompetence and bias, the high court said psychic phenomena had no place in the judiciary. It also called attention to a medical finding that said Floro had psychosis. In the 26-page application he submitted to the JBC, Floro affixed a photograph of himself with bills of money hanging down his neck and standing beside a toy stuffed dwarf. Floro, describing himself in the third person, said he was a “visionary and prophet.”

MANILA, Philippines - Four more nominees for the post to be vacated by Chief Justice Reynato Puno upon his retirement on May 17 emerged last Thursday, the last day for filing of nominations and applications at the Judicial and Bar Council (JBC). The other nominees are Sandiganbayan acting Presiding Justice Edilberto Sandoval and Deputy Ombudsman for Luzon Victor Fernandez. Retired Justice Manuel Lazaro nominated Justice Sandoval while Fernandez applied for the post.

The nominations of Brion, De Castro, Sandoval and Fernandez brought to nine the number of candidates for the chief justice post to be deliberated upon by the JBC. The four who were earlier nominated for the post are Associate Justice Renato Corona, Senior Associate Justice Antonio Carpio, Associate Justice Conchita Carpio-Morales and Special Prosecutor Dennis Villa-Ignacio. MANILA, Feb. 4 – On the last day of submission of application to the Judicial and Bar Council (JBC), two more aspirants on Thursday submitted their nomination for the position of Chief Justice of the Supreme Court (SC). Atty. Victor Fernandez, Deputy Ombudsman for Luzon, manifested his intention to replace Chief Justice Reynato Puno, who is set to retire on May 17, 2010.

Gregorio M. Batiller Jr. obtained his Bachelor of Arts, Cum Laude, in 1975, and his Bachelor of Laws, Valedictorian, in 1979, both at the Ateneo de Manila University, then took the Bar examinations the same year and was topnotcher (First Placer) with a general average of 91.4%.

Former Malabon City Regional Trial Court (RTC) Judge Florentino Floro also applied for the position of Chief Justice. He would like that his nomination be submitted to President Gloria Macapagal-Arroyo. Floro, an alleged psychic, became controversial after he was dismissed from the service by the SC for his conversations with his alleged dwarf friends. He was suspended in 2006 due to mental illness.

Likewise, three nominees were also endorsed for the position of Chief Justice namely, Associate Justice Arturo Brion, Atty. Henry Villarica and Atty. Gregorio Batiller, Jr. There are now nine official nominees before the JBC for the position of Chief Justice, including Associate Justice Renato Corona who manifested his intention to become a nominee without any condition while Senior Associate Justice Antonio Carpio and Associate Justice Conchita Carpio-Morales both expressed their intention to become nominees as Chief Justice premised on the condition that the JBC shortlist of nominees will be submitted to the next president and not to President Arroyo.

Last week, I wrote about my naked ambition to become the next Supreme Court Chief Justice. Joining me in that quest, according to news reports, is none other than former Judge Florentino Floro Jr., who was earlier dismissed from the judiciary for his avowed ability to talk to dwarves.

Judge Floro (can I still call him a judge even after he’s been dismissed?) was booted out after the Supreme Court took him to task for consulting dwarves during healing sessions in his august chambers. Reportedly, there was also a medical report that said he had psychosis. A google search revealed that Judge Floro claims to be an angel of death, able to cause pain to his court audience, and that he can actually write while in a trance. Well, those credentials aren’t so bad. And Wikipedia says he’s a graduate of the Ateneo law school. Considering my lean C.V., he might actually give me stiff competition.

Judge Floro supposedly attached a picture of himself standing beside a stuffed dwarf. That was actually one of the conundrums I faced when deciding which photo to submit. I obsessed a little on whether I should go to a professional photographer, and hire a make-up artist to airbrush my natural good looks (ahem) to pictorial perfection. I also put some thought into the issue of whether I should wear a suit (to convey that I’m used to a high-pressure corporate environment) or a barong tagalog (to denote my pride at being Filipino).

As my friend gave me hardly any time to focus, I ended up running to the nearest photo-me booth and posing in a simple green checked shirt with a white collar. Compared to Judge Floro, who was reportedly wearing money bills in his picture, my outfit now seems appropriately conservative. I didn’t know this before, but apparently, applicants also have to submit a six-page application
form. Browsing through this form (called the JBC Form – 1), I found many things that one might consider irrelevant and frankly, even an invasion of privacy.

Why would there be a need, for example, to disclose my height (in meters) and my weight (in kilos)? I already find it excruciating to look at the weighing scale, do I have to share my distress with the rest of the world? I’ve also developed a (minor) defensive attitude towards being called vertically challenged – do I have to be reminded I’m less than six feet tall? And the age requirement! No need to explain that one.

Scanning the form, I came across Item 24: Litigation Experience. (That should be fairly straightforward, I thought.) Then, one of the sub items under this heading asks the applicant to disclose how many cases he or she has won over the past five years, and more importantly, how many cases were lost. Uh-oh. Is the applicant going to be judged on this basis, when the vagaries of litigating cases in this country may not necessarily lead to results based on the abilities of a lawyer?

The next section, Item 25, asks the applicant for his judicial experience. Good for me. As I have none, I can skip to the next section. As for Judge Floro, I wonder how he’ll do on this one, although Item 28 is the question that might really trip him up. This was the section titled “Formal or informal complaints filed against you.” In ominous tones, the item goes: “Have you ever been charged with violation of any law, decree, ordinance, administrative issuance, or regulation before any court, prosecution office, tribunal, or any other government office, agency or instrumentality in the Philippines or in any foreign country?”

Elimination process for next CJ starts

The enemies of Judge Floro are more sophisticated than this healthy piglet with three eyes and two snouts; it was born in a litter of eight on February 5, 2010 and weighs about the same as the other piglets in the litter in Narvacan, Ilocos Sur.

Amid the controversy over the appointment of the country’s next Chief Justice, a Supreme Court magistrate has thrown his support behind the decision of the Judicial and Bar Council to proceed with the screening of candidates to replace Chief Justice Reynato S. Puno. “I am confident that the JBC, under the leadership of Chief Justice Puno, shall fully and lawfully discharge its duties under the Constitution,” said Associate Justice Arturo D. Brion, a contender for the post that will be vacated when Puno retires in May. Brion made the statement as the JBC begins Monday the elimination process involving nine applicants and nominees for the position.

SC Spokesperson Jose Midas Marquez said the JBC will examine all letters of application and recommendation as well as the confirmation by the nominees which were received by the council from the time the nomination process was formally opened on January 20 up to the February 4 deadline. “(The) JBC will meet on Monday and all of these (letters) will be included in its agenda,” Marquez said.

JBC is composed of Puno as ex-oficio chairman, and Justice Secretary Agnes Devanadera, Sen. Francis Escudero and Quezon City Rep. Matias Defensor as ex-oficio members. Its regular members include Justice Regino Hermosisima Jr., Dean Amado Dimayuga, Justice Aurora Santiago Lagman and lawyer J. Conrado Castro of the Integrated Bar of the Philippines.

Judge Floro, the "Prophet," if filmed, would surely topple Avatar and Dear John (a 2010 American romantic drama/war film starring Channing Tatum and Amanda Seyfried. Directed by Lasse Hallström, the film is an adaptation of Nicholas Sparks' novel of the same name. It shows the life of a young woman (Amanda Seyfried) after she falls in love with a soldier (Channing Tatum). They decide to exchange letters to each other after he is deployed to the war).

The film was released theatrically in North America on February 5, 2010. Dear John debuted as the No. 1 movie with $32.4 million in its opening weekend, knocking off Avatar after seven weekends in first place. The film also sets a record opening for Super Bowl weekend, topping the $31.1 million debut for Hannah Montana & Miley Cyrus: Best of Both Worlds Concert in 2008. It is reportedly the best debut for a film based on a Nicholas Sparks novel.

Aside from Brion, also vying for the top judicial post are SC Associate Justices Antonio T. Carpio, Renato C. Corona, Conchita Carpio Morales and Teresita Leonardo De Castro, acting Sandiganbayan Presiding Justice Edilberto G. Sandoval, Special Prosecutor Dennis M. Last January 18, the JBC unanimously agreed to start processing the nominations for the next SC chief but deferred its decision on when to submit the shortlist of nominees to the “proper appointing authority.” Some quarters believe the President could still appoint Puno’s replacement notwithstanding the ban, which they claimed only covers positions in the executive branch.

MANILA, Philippines - Law students, businessmen and former senior government executives on Monday protested a plan by President Arroyo to appoint a new Chief Justice before she steps down from office on June 30, 2010. In a full-page ad published in major broadsheets, members of the Former Senior Government Officials (FSGO) and business leaders said Malacañang's "brazen and sly attempt" to appoint the next Chief Justice was a ploy to "shield the guilty from accountability."

A former judge dismissed from the judiciary for consulting “dwarves” in his decisions has filed an application with the Judicial and Bar Council (JBC) to be next chief justice of the Supreme Court (SC). Florentino Floro, formerly of the Malabon regional trial court in a “verified application and nomination” nominated himself to the collegial body which is coming up with a shortlist of hopefuls for the CJ position.

Floro, who has described himself “a visionary and a prophet” and once claimed to have been levitated one inch beside a duhat tree while three dwarf friends appeared to him, said he wants his name “as one of the list of the nominees only to President Arroyo, that is, not to the next prime minister or president.” He also asked the JBC to consider five others including Associate Justices Arturo Brion and Conchita Carpio-Morales, “subject to their ratification of the nomination or later consent.”

Undaunted by his threats of “ungodly reprisals,” SC magistrates earlier ordered Floro to stop badgering them with phone calls and pleadings seeking a review of his case. Floro was also warned that he can be held liable for indirect contempt should he persist in disregarding lawful orders of the Court. The SC said Floro failed to present convincing arguments and substantial evidence to warrant a modification or reversal of its March 31, 2006 decision that ordered his relief as Malabon judge due to a “medically disabling condition of the mind that renders him unfit to discharge the functions of his office.”

The high court further ordered to expunge his petitions from the records and ruled that no further pleadings from the former judge would be entertained, citing basic rules under the judicial system that litigations must end and terminate at some point. “We wish to remind Judge Floro that the Court cannot be swayed to modify or reverse its decision and various resolutions by inundating the ponente with numerous pleadings avowing ungodly reprisal as well as personal letters/telephone calls seeking audience with the latter, if, as in this case, they are only in furtherance of repeating issues and arguments already passed upon by the Court en banc’s earlier decision and resolution,” the SC said.

In the assailed decision of the SC, penned by Associate Justice Minita Chico-Nazario, Floro was separated from service due to his “delusional” tendencies, citing his admissions in several occassions that he decides his case with the guidance of his three dwarf friends whom he named Armand, Luis and Angel. As a matter of equity, the Court resolved to award Floro back salaries, allowances and other economic benefits corresponding to three years.

Floro subsequently filed on separate dates three partial motions for reconsideration and supplements, which were all denied by the SC for lack of merit, considering the case closed and terminated, stating that no other pleadings will be entertained in the future. In obvious disregard of this directive, Floro incessantly filed several more pleadings, including a Motion for Leave of Court to reinstate him as judge and a letter stating that he is willing to work under the offices of three justices or the Office of the Chief Justice, by way of reconciliation.

He also filed a supplement to his original letter to reopen his case and to seek a new docket number to his original petition and to designate Senior Associate Justice Leonardo Quisumbing or Sandiganbayan Associate Justice Gregory Ong as new ponente of this “new” case. Floro was sued by the Office of the Court Administrator which investigated about 13 administrative cases lodged against him by his own judicial staff. The SC found him guilty of seven out of 13 administrative charges and ordered him to pay the amount of P40,000 as penalty.

In his 79-page motion for reconsideration, in which pages of stories about himself were interspersed, Floro alleged that the six government doctors who examined him counterfeited his intelligence quotient and wrongfully declared him as mentally impaired. He asked that an impartial panel of doctors who are experts who are also gifted to assess his psychic powers should be commissioned to examine him to determine his true mental state.

The beleaguered judge said that the amended Rule 140 in the Rules of Court never included weirdness, healing, psychic phenomena and the like as grounds for discipline.“Insanity is, but respondent has never been declared insane,” he said, noting that his gift “dwells in the realm of both religious and religious belief, free exercise and expression or parapsychology, and beyond the four corners of medicine, psychiatry and psychology.”

Floro, who has repeatedly cited in his motion that he was the brightest in his class and graduated with honors from Ateneo de Manila and even landed 12th in the 1983 Bar exams, aaid that the SC should not allow itself to be dictated upon by in a proceeding to remove judges based on the medical incapacity of doctors, whose claims are mere hearsay evidence and thus inadmissible. Dr. Celeste Vista in her report to the SC cited that despite Floro’s “impressive educational background, there is an impairment in reality testing which is an indicator of a psychotic process, such that, cultural beliefs in dwarfs, psychic and paranormal phenomena and divine gifts of healing have become incorporated in a delusional system, that it has interfered and tainted his occupational and social functioning.”

Among the “phenomena” that he supposedly predicted were the failure of former President Joseph Estrada to finish his term, the 2001 terrorist attack at the World Trade Center in the United States and the July 2001 fire that gutted the Malabon Hall of Justice, except his own sala, which he predicted on July 18, 1999. MANILA, Philippines — The Judicial and Bar Council excluded a self proclaimed “fifth best psychic in the country” from the list of aspirants for the position of Chief Justice. Court Administrator Midas Marquez said the Supreme Court ruling is explanation enough why he should not be included in the nominees. The high court recently issued a per curiam ruling telling former Malabon Regional Trial Court Judge Florentino Floro that it “will throw the book at him if he keeps on badgering justices with phone calls and pleadings seeking a review of his removal from office.”

Supreme Court spokesman Jose Midas Marquez said the publication of the JBC list will run for two weeks in newspapers of national circulation. Following the publication of the names of the aspirants, the JBC will accept comments from the public. Based on these comments, it will decide on whether to hold public interviews on the aspirants. The JBC officially closed the nomination on February 4, with eight applicants.

My brother and my friend Atty. Tonson were still working in the Supreme Court when Floro was removed and sacked as judge for consulting “duendes” or “dwarves” in his decisions. Decisions have to be decided on facts, on the laws applicable, or in short the law of the land when the case is heard. But the former judge had to consult not his books but his “duendes”. He could argue that people consult “astrologers”, “geomancers” and “feng sui “ experts but as a judge he is dispensing justice. The lady of justice wears a blindfold, and carries the scales and displays a sword. No, she does not consult duendes.

Floro calls these spirits which he consult as “spirit guides when he writes his decisions, that’s what makes him different from those who consult horoscopes, astrologers, geomancers and the like. Dispensing justice can result in someone losing property, someone getting jailed, someone getting vindicated and how to arrive at a decision should require a judge to study the case carefully. Is it justice to send an accused to prison for say 10 to 12 years because a “duwende” told him so? Or for a judge to order a businessman to pay up his creditor because “a spirit” told him to write such order?

Judges are guided by the Constitution, the laws of the land, jurisprudence (decisions rendered by the Supreme Court), the evidence being shown and by legal ethics as well as rules being issued by the Supreme Court. The act of the former judge in appearing before the media last night is a great disservice to members of the judiciary and to lawyers as a whole.Media should not have covered it, we don’t need circuses that make fun of institutions in this country. He is making fun of us and I don’t find the joke funny.

Jose Midas Marquez, agad inalis ng JBC ang pangalan ni Floro sa mga posibleng nominado sa pinakamataas na posisyon sa hudikatura dahil una na itong sinibak sa pagiging hukom. Kung tutuusin aniya, wala ng paliwanag na dapat ibigay ang JBC dahil matagal ng nagdesisyon ang Korte Suprema na hindi karapat dapat si Floro na manatili sa hudikatura matapos nitong aminin noon na kinukunsulta niya ang mga kaibigan na dwende sa pagdedesisyon sa isang kaso. Kamakailan lamang ay nagpalabas ang Supreme Court ng per curiam decision kung saan sinabihan na si Floro na babatuhin na siya ng libro kung patuloy niyang kukulitin ng tawag ang mga SC justices at kung patuloy itong maghahain ng mga pleadings na humihiling na repasuhin ng Korte Suprema ang desisyon nito ng sibakin siya sa pwesto.

TWO more Supreme Court justices were nominated to the post of chief justice, bringing to 10 the total number of candidates to the job that would be vacated by Chief Justice Reynato Puno on May 17. The two are Associate Justices Arturo Brion and Teresita Leonardo de Castro. Brion, who was the last to submit his nomination on Thursday, was nominated by the Philippine Constitution Association (Philconsa) and Court of Appeals Associate Justice Jafar Dimaampao.

The other nominees are Ombudsman Special Prosecutor Dennis Villa-Ignacio, Deputy Ombudsman for Luzon Victor Fernandez, former Judge Florentino Floro of the Regional Trial Court of Malabon City (Metro Manila), laywer Henry Villarica and lawyer Gregorio Batiller Jr.

Thursday, February 4, 2010 AN ASSOCIATE Justice of the Supreme Court (SC), a deputy Ombudsman, and a dismissed judge are the three new additions to the list of nominees who vied for the soon-to-be vacant position of chief justice. As the Judicial and Bar Council (JBC) officially closed off the nomination process Thursday, Associate Justice Teresita Leonardo-de Castro, Deputy Ombudsman for Luzon Victor Fernandez, and dismissed Malabon judge Florentino Floro Jr. beat the deadline for submission of their application for the post. Floro was presiding judge of branch 73 of the Malabon regional trial court but was dismissed in 2006 due to “medically disabling condition of the mind that renders him unfit to discharge the functions of his office.”

He was sued by the Office of the Court Administrator which investigated about 13 administrative cases lodged against him by his own judicial staff. The SC found him guilty of seven out of 13 administrative charges and ordered him to pay the amount of P40,000 as penalty. Floro, who has repeatedly cited in his motion that was he the brightest in his class and graduated with honors from Ateneo de Manila and even landed 12th in the 1983 Bar exams, said the SC should not allow itself to be dictated upon by in a proceeding to remove judges based on the medical incapacity of doctors, whose claims are mere hearsay evidence and thus inadmissible.

He said he could not be held liable for the justices’ emotional incapability to accept his “gift” with empirical certainty. Among the “phenomena” that he supposedly predicted were the failure of former President Joseph Estrada to finish his term, the 2001 terrorist attack at the World Trade Center in the United States and the July 2001 fire that gutted the Malabon Hall of Justice, except his own sala, which he predicted on July 18, 1999.

Bersamin, the Court thus directed the Judicial and Bar Council (JBC) to resume its proceedings for the nomination of candidates to fill the pending vacancy created by Chief Justice Reynato S. Puno’s compulsory retirement on May 17. The Court also directed the JBC to prepare the short list of nominees for the position of Chief Justice and submit the same to President Arroyo on or before May 17, 2010. Likewise, it directed the JBC to continue its proceedings for the nomination of candidates to fill other vacancies in the Judiciary and submit to the President the short list of nominees corresponding thereto in accordance with its decision in the cases at bar.

Concurring with Justice Bersamin, who also opined that the exemption covers the entire Judiciary are Justices Teresita J. Leonardo-De Castro, Martin S. Villarama, Jr., and Jose Perez. Justice Roberto A. Abad wrote a separate concurring opinion. Justice Arturo D. Brion also concurred in that “appointments to the Supreme Court are not subject to the election ban under Section 15, Article VII,” but wrote a separate opinion that he “disagrees with the conclusion that the incumbent President’s authority to appoint extends to the whole Judiciary.” He was joined by Justices Diosdado M. Peralta, Mariano C. Del Castillo, and Jose C. Mendoza.

Justice Conchita Carpio Morales dissented, while Justice Antonio Eduardo B. Nachura, who was joined in his separate opinion by Justice Presbitero J. Velasco, Jr., voted to dismiss all petitions for being premature. Justice Nachura did not any more discuss the issue on whether or not the incumbent President can appoint the successor of Chief Justice Puno. Chief Justice Reynato S. Puno, Senior Justice Antonio T. Carpio, and Justice Renato C. Corona did not take part.

Ramón del Fierro Magsaysay (August 31, 1907 - March 17, 1957) was the third President of the Third Republic of the Philippines from December 30, 1953 until his death in a plane crash in 1957. He was elected President under the banner of the Nacionalista Party. In the Election of 1953, Magsaysay was decisively elected president over the incumbent Elpidio Quirino. He was sworn into office wearing the Barong Tagalog, a first by a Philippine president. He was then called "Mambo Magsaysay."

Meanwhile, Roxas (May 28, 1946 and July 4, 1946), Quirino (April, 1948 and December 30, 1949), Garcia (March 1957 and December 30, 1957) and Arroyo (January 2001 and June 30, 2004) all took their oaths twice.

President Manuel Roxas was inaugurated as the 5th President of the Philippines and the first president of the Third Republic on July 4, 1946 at the Independence Grandstand (now Quirino Grandstand), Manila.

Vice-President Elpidio Quirino was inaugurated as the 6th President of the Philippines on April 17, 1948 at the Council of State Room, Executive Building, Malacañan Palace.

Vice-President Carlos P. García was inaugurated as the 8th President of the Philippines upon Magsaysay's death on March 17, 1957. at the Council of State Room, Executive Building, Malacañan Palace. The oath of office was administered by Chief Justice Ricardo Paras on March 17, 1957.

In the 1961 presidential election, Diosdado Macapagal ran against Garcia's re-election bid, promising an end to corruption and appealing to the electorate as a common man from humble beginnings. He defeated the incumbent president with a 55% to 45% margin. His inauguration as president took place on December 30, 1961.

Roxas had to retake his oath after the Philippines became independent from the United States on July 4, 1946. He became the president of the Republic of the Philippines after the country ceased being a Commonwealth nation.

Former Malabon City Regional Trial Court (RTC) Judge Florentino Floro, who believes in “dwarfs,” is seeking a seat in the Supreme Court (SC) with the forthcoming retirement of Associate Justices Antonio Eduardo Nachura on June 13, 2011 and Conchita Carpio-Morales on June 19, 2011, respectively.

In the 3rd Supplemental Agenda of the Judicial and Bar Council (JBC), Floro applied for one of the two impending vacant positions as SC justice.

Floro is known for his “Gabay” during his time in the judiciary, but was dismissed from the service by the SC en banc for not believing in him that he has a “spiritual guide” in life.

It was learned that Floro’s name was originally excluded from the list because of his dismissal from the service, but he would be reinstated in the publication.

There were original 28 aspirants who applied for the position as SC Justice, but it was extended by the JBC and it was now expanded to 35 with seven more applicants, including Floro.

The other new applicants for the SC posts include Court of Appeals (CA) Associate Justice Amelita Tolentino, who convicted Hubert Jeffrey Webb and several other accused in the Vizconde massacre case during her time as Paranaque City RTC Judge.

University of the East (UE) College of Law Dean Amado Valdez is also seeking the position of SC Justice. Valdez is a noted legal expert and erstwhile Chief of the Office of the Government Corporate Counsel (OGCC).

The other aspirants are law practitioners Sabino Padilla IV, Eduardo Lizares, Pablito Sanidad and Katrina Legarda.

The JBC, chaired by SC Chief Justice Renato Corona, will have its next meeting on May 23.

A judge has lost his job in the Philippines, on the grounds that he regularly consulted with imaginary mystical dwarves who would join him in 'healing' sessions. Judge Florentino Floro, from Manila, was originally removed from his post, after it emerged that he believed himself to be psychic, and that he would begin his court session with readings from the Book of Revelation. In appealing that decision, Judge Floro mounted a staunch defense of the existence of his three dwarf friends - who were named Armand, Luis and Angel - telling the court in a letter that they had made a covenant together.

'From obscurity, my name and the three mystic dwarves became immortal,' he added. In addition to the mystical dwarves, Judge Floro also reportedly believed that he was able to foresee the future, that he could inflict pain on others, and that he was the angel of death. He would change his judicial robes from blue to black every Friday to recharge his psychic powers.

The court found that he was unable to carry out his duties due to 'mental unfitness', adding that this could 'erode the public's acceptance of the judiciary as the rational guardian of the law.' Armand, Luis and Angel were unavailable for comment.

The May 2011 tornado was the deadliest tornado to hit the United States since 1947 and the eighth-deadliest single tornado in U.S. history, killing 142 people, though the toll is likely to rise still further as more of the missing are recovered and definitively identified.

Officials said late May 29, 2011, that at least 43 people remain missing, down from a list of 232 missing persons that was released on May 26. The Missouri State Emergency Management Agency has confirmed that 142 people were killed and more than 990 were injured in Joplin. The number of dead may rise, as more than 100 people remain missing. However, due to the horrific injuries suffered by some victims, it is possible that some different sets of remains are from a single person. The figure of 142 deaths would make this the deadliest U.S. tornado since that of April 9, 1947 in Woodward, Oklahoma and surrounding locations, and the eighth deadliest tornado in U.S. history.[16] This would also make it the first single tornado since the June 8, 1953 tornado in Flint, Michigan, to have 100 or more associated fatalities.

Even so, a series of disturbing incidents appear to have the nation's top jurists rattled. According to local newspaper reports, a mysterious fire in January destroyed the Supreme Court's crest in its session hall, and a number of members of the court and their close family members have developed serious illnesses or have fallen victim to car accidents.
Enough bizarre things have happened that in July, the Supreme Court issued an en banc resolution asking Mr. Floro to desist in his threats of "ungodly reprisal." The Supreme Court's spokesman declined to elaborate.

1. November 8, 2007: Dulce Saguisag, wife of Judge Floro's lawyer, Atty. Rene AV Saguisag, was killed in a serious car accident on November 8, 2007, on President Osmeña Highway in Makati City. Her husband, Rene Saguisag, was seriously injured in the accident. Two other people riding in the same Toyota Grandia van as the Saguisags, including Filipino dance instructor, Rhea Imelda Obong, and driver, Felipe Calvario, were also seriously injured in the accident.

All four were rushed to Ospital ng Makati where Dulce Saguisag was pronounced dead from her injuries. The Toyota that Ducle Saguisag was riding in, which was travelling on Pasay Road, was struck by a dump truck at the corner of the President Osmeña Highway in Makati City at about 2 A.M. The dump truck had reportedly been speeding when it ran a traffic light and struck the left side of the Saguisags' van, killing Dulce. Police arrested the driver of the dump truck at the scene of the accident.

2. Monday, December 20, 2010 Hon. Reynaldo Laigo & wife killed in traffic accident RETIRED judge of the Makati City regional trial court and his wife were killed on their way to "simbang gabi" when a passenger bus clipped theiraboard a two-door Mitsubishi mini-Pajero vehicle along Commonwealth avenue in Quezon City at half past four Monday morning. A report from the Quezon City Police District said Judge Reynaldo Laigo and his wife Lilia were coming out of the Don Jose Subdivision in their mini Pajero when a speeding Corimba Express bus driven by Generoso Magante Jr. hit the left portion of their vehicle.

The Laigos were reportedly pinned inside their vehicle and it took rescue teams more than 20 minutes to free them and take them to the hospital. Both were declared dead on arrival at the hospital, Judge Laigo at the Fairview General Hospital and his wife at the East Avenue Medical Center. Before his retirement last July, the soft-spoken Laigo decided controversial cases during his four years as presiding judge of Branch 56 of the Makati regional trial court.

MANILA, Philippines—Seconds before the taxi conveying journalist Lourdes “Chit” Estella-Simbulan was rammed by a bus Friday night, another speeding bus nicked the vehicle on Commonwealth Avenue in Quezon City, police said Saturday.

But it was the impact from the second bus that pinned the veteran journalist and U.P. professor to death in the cab's backseat. Estela-Simbulan, 53, was reportedly on her way to a reunion with friends.

Like the Dulce saguisag car accident, where LUIS spared the lives of Filipino dance instructor, Rhea Imelda Obong, and driver, Felipe Calvario, both being virtually unhurt, LUIS also was compassionate upon the taxi driver of Simbulan, since he sustained zero injury.

Sen. Francis Escudero sustained slight hand injuries after figuring in a road accident when their cars collided at the intersection of Don A. Egea and Maryland Streets in Barangay (village) Pinagkaisahan, Cubao, Quezon City, Thursday night around 9:30 p.m.

Escudero was driving along Don A. Egea from E. Rodriguez Sr. Boulevard and was heading towards New Orleans St., while Merilles was traveling along Maryland St. from New York St. on his way to E. Garcia St.

Task Group Olea was formed to conduct investigation on the case, said Natuel.

The United States-based Committee to Protect Journalists earlier listed the country as the 3rd most dangerous place for journalists, next to Iraq and Somalia. Its rank was unmoved from the 2010 report. The CPJ recorded 69 journalists murdered since 1992. – Romeo Losantas Olea, 49, of San Miguel, Iriga City, a radio broadcaster of DWEB-FM in Nabua, Iriga City in Camarines Sur, Bicol was shot dead this morning, bringing the number to 4 cases in 2011. At least two empty shells from a 9-mm pistol were recovered from the scene.

The first work-related killing of a journalist under the year-old Aquino administration and first case in the province was that of another dwEB broadcaster, Miguel Belen, in July 2010. Belen, who had been reporting on local elections and corruption, was shot on 9 July and died on 31 July. Before he died, he identified an Eric Vargas and a Gina Bagacina as his attackers. Murder charges have already been filed against the two.

Fewer than 10 people have been convicted in about 145 media killings since 1986, when democracy was restored, said National Union of Journalists of the Philippines President Nestor Burgos Jr. Out of the 145 deaths, more than 100 occurred since 2001.
In 2009, at least 31 journalists were among 57 people massacred in a political killing allegedly carried out by members of a powerful provincial clan in the southern Philippines. The body of a 32nd journalist who was part of the convoy has not been found.

Cervical radiculopathy occurs when a nerve in the neck is irritated as it leaves the spinal canal. The Supreme Court released this Resolution dated July 12, 2011, on July 22,2011. It NOTED, meaning no action yet, or for further study, the 79 pages July 1, 2011 Letter-Requests filed by Judge Floro. 4 SC Justices were on leave, that July 12, while Justice Abad did not take part since he is counsel of Justice Benipayo.

This true-color simulated view of Jupiter is composed of four images taken by NASA's Cassini spacecraft. These images were combined and the cylindrical map projected onto a globe in order to illustrate what Jupiter would look like if the cameras used to image this planet had a field-of-view large enough to capture the entire planet. The resolution is about 144 km (89 miles) per pixel. Jupiter's moon Europa is casting the shadow on the planet. Jupiter, the most massive planet in our solar system -- with dozens of moons and an enormous magnetic field -- forms a kind of miniature solar system. Jupiter does resemble a star in composition, but it did not grow big enough to ignite. The planet's swirling cloud stripes are punctuated by massive storms such as the Great Red Spot, which has raged for hundreds of years.

Juno is a NASA New Frontiers mission to the planet Jupiter. It was originally proposed at a cost of approximately US$700 million (FY03) for a June 2009 launch. NASA budgetary restrictions resulted in Juno being re-scheduled to an August 2011 launch on board an Atlas V rocket in the 551 configuration. As of June 2011, the mission was projected to cost $1.1 billion over its life. Juno was launched from the Kennedy Space Center on August 5, 2011; after several delays, including a last-minute hold at T-4 minutes, the spacecraft launched at 12:25pm EDT.

The spacecraft will be placed in a polar orbit to study the planet's composition, gravity field, magnetic field, and polar magnetosphere. Juno will also search for clues about how Jupiter formed, including whether the planet has a rocky core, the amount of water present within the deep atmosphere, and how the mass is distributed within the planet. Juno will also study Jupiter's deep winds, which can reach speeds of 600 kilometers per hour (370 mph).
Juno's name comes from Greek and Roman mythology, in which the god Jupiter drew a veil of clouds around himself to hide his mischief, and his wife, the goddess Juno, was able to peer through the clouds and reveal Jupiter's true nature.

Juno requires a five-year cruise to Jupiter, arriving in July 2016. The spacecraft will travel over 716 million kilometers (445 million miles) and will travel faster than 16,000 kilometers per hour (9,900 mph) (4.4 km/s) to reach the planet. The spacecraft will orbit Jupiter 33 times during one Earth year. Juno's trajectory will use a gravity assist speed boost from Earth, accomplished through an Earth flyby two years after its August 5, 2011 launch.

In 2016, the spacecraft will perform an orbit insertion burn to slow the spacecraft enough to allow capture into an 11-day polar orbit. Once Juno enters into its orbit, infrared and microwave instruments will begin to measure the thermal radiation emanating from deep within Jupiter's atmosphere. These observations will complement previous studies of the planet's composition by assessing the abundance and distribution of water, and therefore oxygen. While filling missing pieces of the puzzle of Jupiter's composition, this data also provides insight into the planet's origins. Juno will also investigate the convection that drives general circulation patterns in Jupiter's atmosphere. Meanwhile, other instruments aboard Juno will gather data about the planet's gravitational field and polar magnetosphere. The Juno mission is set to conclude in October 2017, after 33 orbits around Jupiter when the probe will be de-orbited to crash into Jupiter.
